What Should I Do If I Am Injured From A Slip, Trip and Fall?

The most important thing you should do, after seeking medical help, is to get legal advice as soon as possible. To make a successful claim, you must be able to demonstrate the accident was caused by the negligence of your employer for failing to take steps to avoid a slip or trip hazard being present.

You should also ensure that:

  1. The accident is recorded in the Accident Book or similar document
  2. Any CCTV footage is retained
  3. You seek First Aid/Medical Attention as soon as possible
  4. Details of witnesses are obtained
  5. You cooperate with any work accident investigation
  6. Photos of the slip or trip hazard are taken

What Are The Time Limits For Slips, Trips And Falls Claims?

It is also essential to be aware of the time limits that apply in the United Kingdom when making a personal injury claim. The time limit for issuing a claim at court is three years from the date of the accident or from the date the injury was first diagnosed. There are some exceptions, for instance, if the person injured is under 18 (they have until their 21st birthday) or the injured person lacks capacity. But it is important you seek advice as soon as possible, so a qualified solicitor can ensure your claim is made in time. This should be well before the 3 year deadline.

Slips, Trips & Falls Case Study

We represented an individual who worked as a kitchen assistant and was badly injured in a fall. The kitchen floor had been mopped and standing water had been left with no wet floor sign in place. Our client seriously hurt their left wrist, back, and pulled muscles in their shoulders and chest. The injury was very painful, so they were placed on mandatory sick leave and had to wear a wrist splint.

In the year after the accident, our client needed a lot of treatment including physiotherapy. Then Covid arrived, and all treatment stopped. This was very upsetting for our client, as they were not able to use their left hand and remained in a lot of pain. To add insult to injury, they received an email from the Head of the school saying they no longer had a job because they couldn’t give them a return to work date. Our client felt it just proved to them that they were just a number. That’s when they decided to ring Macks Solicitors.

“My solicitor was Anthony McCarthy, he has been fantastic as has his secretary Kym. They went above and beyond to fight my case. I had private scans and appointments and, even though we were still in the middle of the pandemic, they always kept in touch keeping me up to date with the progress of my case. Once restrictions eased, Anthony arranged a face-to-face appointment to discuss my case. They won my case for me, and I’m so grateful for everything they have done. It’s been a long road because of the serious injury I suffered and also Covid but we got there in the end. I would highly recommend Macks Solicitors if anyone is in need of a solicitor following an accident. They keep you at ease with a friendly approach and are such lovely people.”
