Case Study: Accident at work victim secures over £6,500 in compensation claim

by Macks Solicitors

By instructing Macks Solicitors, Terry from Wigan was able to secure £6,500 as compensation for injuries sustained in a work accident.

Terry was employed by a café. Whilst performing his duties, Terry was asked to carry various items of crockery from the ground floor to an upper level.

Terry had negotiated three or four steps before stepping on an area of sticky residue, causing him to slip and fall. As several of the china cups he was carrying smashed, Terry suffered a laceration across his right wrist. Subsequently, Terry’s wound became infected, requiring him to undergo painful daily dressing changes.

Macks Solicitors – the work accident specialists

Terry sought advice from Macks Solicitors. Macks’ work accident department informed him that the café had acted negligently. In failing to prevent the accumulation of the residue, failing to clear the staircase and failing to warn its employees of the danger, Terry’s employer had breached its duty of care. Terry was told that he would be able to claim for any loss arising from this breach.

After admitting liability, and recognising the pain and financial loss that Terry had suffered, the defendant offered £6,500 in compensation. Following Macks’ advice that this figure was likely to be greater than any sum awarded by a court, Terry accepted. In this respect, Terry is not alone. Less than one per cent of the claims made by Macks’ personal injury clients reach court. Most defendants accept the arguments put forward by Macks’ team of legal experts and respond with satisfactory offers of compensation.
